In a letter from the attorneys representing the family of Tamir Rice, they ask that Cuyahoga County Prosecutor Tim McGinty to present aggravated murder charges to the grand jury against Cleveland Police Officer Timothy Loehmann.

The letter details a meeting between the family and two assistant county prosecutors last week “to obtain an update on the status of the criminal investigation of Officers Timothy Loehmann and Frank Garmback.”

The attorneys for the family say that aggravated murder does not require “prior calculation and design”…only a purpose to cause death, where the victim is under the age of 13.

Loehmann shot and killed 12-year-old Tamir Rice, thinking he had a gun after officers were called to Cudell Rec Center Nov. 22. The gun turned out to be an air soft gun toy.
